Court Dismisses Ritu Malu's Application in Ram Jhula Hit-and-Run Case; CID to Handle Bail Cancellation

Nagpur: In a significant development in the Ram Jhula hit-and-run case, the Sessions Court on Monday dismissed an application filed by the accused, Ritu Malu, seeking to quash the bail cancellation request. The court also granted the amendment application submitted by the complainant and reserved the matter for a final order.


During the previous hearing, the complainant's counsel informed the court that the Central Investigation Department (CID) is now responsible for seeking the cancellation of Ritu Malu's bail, following the reassignment of the case investigation from the Tehsil Police. The Nagpur Bench of the Bombay High Court had earlier transferred the investigation to the CID, and the state government requested that the court officially recognize the CID in place of the Tehsil Police Station in its records.


Ritu Malu's counsel argued against this amendment, stating that the Criminal Procedure Code (CrPC) does not provide for such changes and that the CID should file a new application instead. However, the complainant's lawyers cited a Supreme Court judgment, asserting that amendments can be made if they do not harm the opposing party and if the nature of the case remains the same.


The court rejected Malu's application to quash the bail cancellation request initially filed by the Tehsil Police, noting that the CID, having taken over the investigation, has the right to proceed with the application.


Advocate Amol Hunge represented the complainant, while the matter has been reserved for a final ruling. The case, which has garnered considerable attention, continues to be closely followed, as the CID takes charge of the legal process moving forward.
