Nagpur: In a significant development concerning unauthorised construction in the city, the Nagpur Bench of the Bombay High Court on Tuesday recorded an undertaking from a city-based builder to demolish the illegal portion of Poonam Tower located at Vidhan Bhawan Square.


The matter was heard by a division bench in a writ petition filed by Kumar Hotels Private Limited, Nagpur, challenging an order dated January 13, 2026, issued by the Nagpur Municipal Corporation (NMC). The civic body had directed the removal of unauthorised constructions in the building.


During the hearing, the petitioner appeared in person and advanced detailed arguments against the municipal action. However, after considering the submissions, the bench indicated that it was not inclined to interfere with the NMC’s demolition order.


Following this observation, the petitioner informed the court that he would voluntarily demolish the unauthorised structures. He submitted that the demolition work would commence on February 16, 2026, and would be completed by March 31, 2026.


Taking the statement on record as an undertaking, the High Court directed that if the petitioner fails to begin demolition on February 16, the Nagpur Municipal Corporation shall initiate the demolition from February 17 and complete the process as expeditiously as possible.


Advocate Jemini Kasat appeared on behalf of the Nagpur Municipal Corporation. The matter has been listed for further hearing on February 23.


The order underscores the High Court’s firm stance on illegal constructions in Nagpur and reinforces the authority of the civic body in enforcing building regulations.
